Pricing and Errors: All prices are listed in Canadian Dollars (CAD) unless otherwise indicated and are subject to change without notice. We are not responsible for typographical errors regarding price or any other information concerning our products. In the event that a product is listed at an incorrect price due to a typographical error, we shall have the right to refuse or cancel any orders placed for that product at the incorrect price, whether or not the order has been confirmed and your payment method charged. If your payment method has been charged and your order is canceled, we will issue a credit to your account in the amount of the incorrect price.
Order Acceptance: The receipt of your order confirmation email does not constitute our acceptance of your order. We reserve the right, at our sole discretion, to accept or refuse any order you place with us for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraud. We may require additional verification or information before accepting any order. Your order is deemed accepted only when we ship the product(s) and send you a shipping confirmation email.
5. Payment and Billing

You represent and warrant that: (i) the payment information you supply to us is true, correct, and complete; (ii) you are duly authorized to use the payment method for the purchase; and (iii) charges incurred by you will be honored by your payment provider.
You agree to pay all charges incurred by you or any users of your account and payment method at the prices in effect when such charges are incurred. 6. Shipping and Delivery
All shipping and delivery of products purchased through the Site are handled in accordance with our separate Shipping Policy, which is incorporated into these Terms by reference. You can review our Shipping Policy. We are not responsible for delays in delivery that are beyond our reasonable control, such as carrier delays, customs processing, or severe weather events. Title and risk of loss for physical products pass to you upon our delivery of the item to the carrier.

You agree to indemnify, defend, and hold harmless Najiba Housewares Inc. and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of these Terms, your use of the Site, your violation of any law or the rights of a third-party, or your submission of any content that infringes the intellectual property or other rights of any person or entity.
10. Governing Law and Dispute Resolution
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without giving effect to any principles of conflicts of law.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be resolved amicably through good-faith negotiations. If such negotiations fail, the dispute shall be finally settled by the courts of the Province of Manitoba, and you hereby irrevocably attorn to the exclusive jurisdiction of the courts located in Winnipeg, Manitoba.
11. Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

These Terms, together with our Privacy Policy, Refund and Returns Policy, and Shipping Policy (each accessible via our Site), constitute the entire agreement between you and Najiba Housewares Inc. regarding your use of the Site and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
